It will be broken into smaller sections soon May, 2007 Memorandum to Members of The Sea Ranch Association from CM John Fox REORGANIZED RULES OF THE SEA RANCH ASSOCIATION This introduction to the recently reorganized Operating Rules of The Sea Ranch Association is intended to help Association Web site users find Rules which are pertinent to their endeavors and to explain the rationale for reordering and renumbering them. The Rules are also being delivered to Members in a loose leaf, three hole punched format together with The Sea Ranch Design Manual. As new Rules are approved by the Board of Directors, they will be periodically posted on the Web site and delivered to Members in the same format. Authority for this reorganization and redistribution of the Rules is provided in Resolution 252, adopted by the Board on October 22, 2005. Section 5.06 of The Sea Ranch Restrictions provides for the establishment of Rules which, when adopted by the Board, recorded, and provided to all owners, have the same force and effect as the Restrictions. In addition, Community Association Operating Rules are defined in section 1357.100 et. seq. of the California Civil Code. The majority of Sea Ranch Association Rules were enacted as a mix of policies, procedures, or rules prior to enactment of these sections of the Civil Code. Thus, in order to provide Members with a set of Operating Rules separate from policies and procedures, it has been necessary to review all Board Resolutions and identify those which meet the Civil Code definition of Operating Rules. We also wanted to organize the Rules into a logical format for ease of use and updating, requiring a reordering and renumbering of the Rules. We chose the Association office filing system as the organizational basis for accomplishing this. There are now 8 major categories of Rules under the headings of (1) Management, (2) General Administration, (3) Recreation, (4) Government Liaison, (5) Community Development, (6) Security, (7) Facilities & Resources, and (8) Utilities. Thus, for example, former rule numbers 1.01-1.05 regarding Fire Safety are now located in Community Development Rules Section 5.1.01-5.1.05. Former rule numbers 2.01-2.06 regarding Use of The Sea Ranch Facilities are now located in Recreation Rules Sections 3.1.01-3.1.06. All Community Associations face the challenge of finding ways to keep their Operating Rules up-to-date and distributed to the membership. The problem arises because the yearly accumulation of new and revised rules creates a moving target of current rules, and because it is hard to summon adequate resources for the necessary housekeeping. We hope that you will find the revised organization and renumbering of The Sea Ranch Rules to be helpful towards both finding the Rules of interest, and to keeping them up to date as new rules are adopted. We are indebted to Board Member Marti Campbell and several staff members, Darla Buechner, Paula Lim, and Janice Bonora, for this accomplishment.
Section 5.06 of The Sea Ranch Restrictions provide for the establishment of RULES which, when adopted by the Board, recorded, and provided to all Owners, have the same force and effect as the Restrictions. The Sea Ranch Rules are, in effect, regulations which amplify, clarify, define or interpret the Restrictions.
